Manuel Hernandez, the 45-year-old captain of the doomed 22-foot vessel, was initially facing 13 counts of reckless endangerment alongside expected charges of criminally negligent homicide. However, the legal landscape shifted dramatically as the U.S. Attorney's Office for the Southern District of New York stepped in to handle the prosecution, throwing the final scope of Hernandez's charges into a holding pattern.

Terror in the Harbor: A Night Out Turns to Horror

The nightmare unfolded just before 10:30 p.m. on August 8, as the overloaded recreational motorboat cruised the waters near the iconic Statue of Liberty. Witnesses reported the vessel struggling in distress before capsizing into the dark, freezing waters.
