A Manhattan judge has officially declared a mistrial in the third rape trial of disgraced movie mogul Harvey Weinstein. After a grueling three-week trial filled with graphic testimony, a jury of seven men and five women announced they were utterly deadlocked, unable to reach a unanimous decision on whether the 74-year-old former Hollywood titan raped hairstylist and actress Jessica Mann in 2013.
The sudden collapse of the case marks a devastating blow for prosecutors and a stunning repeat of history. This is the second time in a year that a New York jury has failed to reach a verdict regarding Mann’s allegations, leaving the future of the #MeToo flashpoint entirely in limbo.
The Never-Ending Legal Nightmare: Three Trials, Zero Closure
For Jessica Mann, now 40, the mistrial means a decade-long fight for justice remains frustratingly unresolved.
Weinstein was originally convicted of third-degree rape involving Mann back in 2020. However, the New York Court of Appeals threw out that conviction in 2024, ruling the original judge unfairly allowed testimony from women whose allegations weren't part of the criminal charges. When prosecutors retried the case in 2025, the jury deadlocked.
Now, in 2026, history has repeated itself.
Manhattan District Attorney Alvin Bragg expressed deep disappointment but praised Mann's incredible resilience.

The Prosecution's Case

The prosecution detailed how Mann, who had left an evangelical upbringing to pursue acting in Los Angeles, was allegedly pressured into oral sex by Weinstein in California shortly after they met.
The prosecution maintained that during the 2013 incident at a Manhattan DoubleTree hotel, Weinstein forced himself on Mann despite her making it completely clear she did not want to have intercourse.

The Defense's Counterattack
Weinstein’s defense attorney, Jacob Kaplan, painted a radically different picture for the jury. He argued that Mann possessed full agency throughout her interactions with Weinstein and insisted no rape occurred "at any point."
Kaplan heavily emphasized that Mann had ample opportunity to leave the Manhattan hotel room but chose to stay. The defense’s strategy leaned heavily on emails sent before and after the alleged assault, using them to argue that the two shared a complex, ongoing, and ultimately consensual relationship.
Where Does the Fallen Mogul Stand Now?
While this specific trial ended in a stalemate, Weinstein is not walking away completely unscathed.
In a separate New York trial last year, Weinstein was convicted of forcing oral sex on former Project Runway assistant Miriam Haley in 2006 (though he was found not guilty of assaulting Polish model Kaja Sokola).
Yet, the inability of a third jury to convict him on Mann’s charges proves just how difficult it is for prosecutors to secure a unanimous verdict when dealing with the highly complex, gray areas of historic, long-term relationships.
